A garage can look like a straightforward addition to a home, but the question of do garages need approval is rarely answered by a simple yes or no. In NSW, the right pathway depends on the garage’s size, height, location, setbacks, site constraints and whether your property is affected by planning controls such as heritage, flood, bushfire or biodiversity overlays.
Getting this right before plans are finalised matters. A garage placed too close to a boundary, built above the permitted height or positioned over an easement can create delays, redesign costs or problems when you sell. The most cost-effective approach is to check the approval pathway early, then design the structure around what can realistically be approved and built.
Do garages need approval in NSW?
Most new detached garages require some form of formal approval before construction starts. Depending on the property and proposal, that may be a Complying Development Certificate (CDC) or a Development Application (DA) through the local council. After the planning pathway is addressed, building work must also be supported by the appropriate construction approval and inspections.
A small garage is not automatically exempt simply because it is detached or intended for private use. NSW planning rules do allow some minor structures to be exempt development, but the applicable standards are specific. They deal with matters including floor area, building height, setbacks, drainage, location and site conditions. If even one relevant standard is not met, exempt development may not be available.
For many homeowners, a CDC offers a faster and more certain route than a DA where the proposal meets all required criteria. However, CDC is not a shortcut around good design or site constraints. The plans and supporting documentation still need to demonstrate full compliance with the relevant state policy, council controls and building requirements.
Where a garage does not satisfy the CDC standards, a DA may still be a practical and successful pathway. A DA gives council the opportunity to assess the design on its merits, including how it fits the site, neighbouring homes and local character.
The factors that determine your approval pathway
The garage itself is only part of the assessment. The property it sits on often determines whether the project is simple or requires more detailed planning work.
Size, height and location on the block
Council and CDC standards commonly control how large an outbuilding can be, how high it can be and how close it may sit to the front, side and rear boundaries. A garage at the front of a property can require particular care because it affects street presentation, vehicle access and the balance of landscaped area.
Height is not just about the overall roof peak. Wall height, roof form and the way the building presents to adjoining properties can all influence compliance. A skillion-roof garage, for example, may be an efficient solution on a narrow site, but its high point needs to be carefully located to manage boundary and overshadowing issues.
Setbacks are equally important. A garage built close to a side boundary may trigger fire-rating requirements or affect stormwater design. On a sloping block, retaining walls and excavation can add another layer of approval and construction complexity.
Planning controls affecting the land
A property may have constraints that limit the use of exempt development or CDC, even where the garage appears modest. Heritage conservation areas, bushfire-prone land, flood-prone land, coastal locations and environmentally sensitive land can all change the available pathway.
For example, a garage in a heritage area may need a DA so council can consider its materials, roof form, placement and visibility from the street. On bushfire-prone land, the design may need to respond to the applicable Bushfire Attack Level, including construction materials and protection measures. Flood-prone sites may require the garage floor level, materials and location to be assessed against flood planning controls.
These conditions do not necessarily prevent a garage from being approved. They simply mean a standard off-the-shelf design may not be suitable for the site.
Easements, services and access
Before a garage is positioned, the title information and site conditions should be reviewed. Building over or near a drainage easement is a common issue. Even if a structure appears to fit physically, an easement may restrict where it can be built or require separate approval from the relevant authority.
Vehicle access also needs attention. A new garage may require a driveway, crossover or changes to the kerb. If access is from a main road or a corner block, additional controls can apply. The garage should work with the existing site levels and allow practical entry and exit, rather than creating a steep, difficult driveway that is expensive to build.
Stormwater and neighbours
A garage roof adds hard surface area, so its stormwater must be collected and discharged lawfully. In many established suburbs, this can be more challenging than expected, particularly where there is no obvious legal point of discharge or where the site falls towards a neighbouring property.
Neighbour impacts are also relevant. A large boundary garage can affect sunlight, privacy, views and drainage. Thoughtful placement, sensible building height and roof drainage directed within your own property can reduce objections and create a better outcome for everyone.
CDC or DA: which garage approval is right?
A CDC is generally suited to a proposal that can meet every applicable numerical and design standard. It is assessed by an accredited certifier or council, and it can be an efficient option when the site is straightforward and the documentation is complete. The key point is certainty: the proposal must comply, not merely come close.
A DA is often the better route when the site has constraints, the garage needs a variation to a development standard, or the preferred design falls outside the CDC rules. This could include a garage that is larger than permitted under a complying pathway, closer to a boundary, located in a sensitive area or designed as part of a broader renovation or new home project.
A DA can take longer because council assesses the proposal and may notify neighbours or request further information. However, forcing a non-compliant design into a CDC pathway can cost more time than choosing the correct process from the outset. A well-prepared DA should clearly explain the site conditions, demonstrate compliance where possible and justify the design response where a variation is required.
Approval is different from building a compliant garage
Planning approval is not the final step. A garage must also be designed and constructed to meet the National Construction Code and relevant Australian Standards. This includes structural design, footings, slab details, framing, drainage and, where applicable, fire separation.
The requirements change depending on whether the garage is detached, attached to the home, close to a boundary or located below another part of the building. An attached garage can affect the dwelling’s fire safety and internal access arrangements. A detached steel shed may still need engineered footings and certification based on wind conditions, soil classification and the manufacturer’s specifications.
This is why a basic sketch or supplier brochure is not enough for many approval applications. Clear architectural drawings, a site plan, levels, stormwater information and consultant reports where required give the certifier or council what they need to assess the proposal properly.
Common mistakes that cause garage delays
The most frequent issue is starting with a preferred size or supplier package before confirming what the site allows. A standard double garage may be too high, too large or too close to a boundary once local controls are applied.
Another common mistake is assuming an old structure does not need to be considered. If an existing garage was built without approval, replacing it can expose the issue. The replacement may need to be assessed as a new structure, and council records or historic approvals may need to be reviewed before proceeding.
Homeowners also sometimes overlook drainage, easements and levels until the construction stage. By then, moving the garage or redesigning the slab can be costly. Early site investigation is far less expensive than correcting a problem after materials are ordered.
A practical way to plan your garage
